- About Comemoralis
Comemoralis is a digital remembrance initiative for preserving memories, creating and administering Memorials, sharing Tributes and supporting remembrance-related activities.
Comemoralis is currently operated and developed by Creative IT Media S.R.L.
The project is being developed with a long-term non-profit and public-interest mission, with the intention that its activities and objectives may in the future be supported or carried forward through a dedicated Comemoralis Foundation, subject to its formal establishment and the applicable legal and organisational arrangements.
Until any such transition is formally completed, Creative IT Media S.R.L. remains the legal operator of Comemoralis.
Full operator information is available on our Legal Information page.
References in these Terms to “Comemoralis”, “we”, “us”, “our” or the “Platform” refer to Comemoralis as currently operated by Creative IT Media S.R.L., unless the context clearly indicates otherwise.
By creating an account, administering a Memorial, submitting content or using other interactive Comemoralis features, you agree to these Terms to the extent applicable to your use of the Platform.
- Eligibility
You must be at least 18 years old to create a Comemoralis account or use the Platform as a Creator.
By creating an account, you confirm that you meet this requirement and that the account information you provide is accurate to the best of your knowledge.
Comemoralis does not currently operate a separate service designed for children or a parental-consent account workflow.
- Accounts and authentication
You may create an account using the authentication methods currently made available by Comemoralis, including a local account or Google sign-in where available.
You must:
provide accurate account information;
keep your authentication credentials secure;
not intentionally impersonate another person;
not use another person's account without authorisation;
notify us if you reasonably suspect unauthorised access.
Email verification confirms control of an email address. It does not establish civil identity, family relationships, inheritance rights, copyright ownership or other legal authority concerning a Memorial or its content.
Saving a Memorial as Draft does not publish it.
Publication requires a verified email address and all other applicable publication, payment, visibility and moderation requirements.
- Memorial creation and administration
A Creator may administer one or more Personal Memorials and, where available, Collective or Community Memorials.
Comemoralis may also create and administer platform-owned or Editorial Memorials through authorised Staff.
Being the administrator of a Memorial means that you may manage it using the controls provided by Comemoralis. It does not automatically establish ownership of every photograph, text, historical record or other item associated with that Memorial.
Administration does not establish legal authority over a family, estate, deceased person's rights, cemetery record or another person's intellectual property.
Shared administration, ownership transfer, inheritance of a Comemoralis account or automatic transfer of a Memorial to another person are not promised unless a specific Platform feature expressly provides them.
- Public and Private visibility
An eligible Public Memorial may be accessed publicly and may be indexed, cached or otherwise processed by search engines and independent third-party services.
A Private Memorial is intended to be:
excluded from Comemoralis public discovery;
marked not to be indexed by search engines; and
accessible through its valid direct URL when applicable publication and lifecycle conditions allow access.
Private does not mean password-protected or restricted exclusively to authenticated family members.
Anyone who receives a Private Memorial URL or QR code may potentially forward it to another person.
Comemoralis cannot guarantee when independent search engines or third parties will remove cached or previously copied information.
Draft, Archived and Suspended Memorials are not normally available through the public Memorial route.
Billing and Preservation restrictions may apply separately from visibility settings.
- Your content and responsibilities
You are responsible for the content you submit to Comemoralis.
You must submit only information, photographs, media and other material that you may lawfully provide and use.
You must not knowingly infringe another person's:
copyright or other intellectual-property rights;
privacy or data-protection rights;
image or personality rights;
confidentiality;
other legally protected interests.
Information concerning living persons must be handled carefully and lawfully.
Do not submit unnecessary sensitive information about living persons. In particular, you should not submit special-category or similarly sensitive personal information about another living person unless there is a clear lawful basis and the information is appropriate and necessary for the relevant Memorial context.
Comemoralis may restrict, hide or remove information where necessary to comply with applicable law, infrastructure-provider requirements, these Terms or Platform policies.
You remain responsible for the accuracy and lawful submission of your contributions.
Comemoralis does not independently pre-verify every factual statement, family relationship, permission, copyright claim or historical assertion submitted by users.
- Limited licence to operate the service
You retain any copyright and other rights that you lawfully hold in the original material you submit.
By submitting content to Comemoralis, you grant Comemoralis a non-exclusive, worldwide and royalty-free licence limited to what is reasonably necessary to provide, maintain and operate the Platform.
This may include:
hosting and storing the content;
technical reproduction;
displaying it according to the selected visibility;
formatting and resizing;
technically necessary conversion or transcoding;
making it available through Platform sharing features;
backup and recovery;
moderation and security processing.
Technical providers acting for Comemoralis may perform these activities only as necessary to provide the relevant services.
This licence is not a transfer of copyright and does not permit Comemoralis to exploit your content for unrelated purposes merely because you uploaded it.
Following deletion, continued processing is limited to circumstances such as technical backup cycles, content still legitimately referenced elsewhere, legal obligations, security requirements, disputes and other justified retention described in these Terms and the Privacy Policy.
- Tributes and participation
Visitors may be able to submit Tributes, condolences, memories, photographs or other permitted contributions to a Memorial.
Guest Tributes require private email verification before publication.
Submitting a guest Tribute does not automatically create a Comemoralis account.
Where available, creating an account and linking an eligible guest Tribute are separate choices.
Tributes linked to an account are subject to the applicable account-deletion rules.
Creators may manage Tributes on Memorials they administer using the controls provided by Comemoralis.
All contributions remain subject to:
these Terms;
moderation;
the availability of the relevant Memorial;
its visibility;
applicable Preservation restrictions.
Submitting a Tribute does not grant ownership or administrative rights over the Memorial.
- Prohibited content and conduct
Comemoralis is intended to provide a respectful environment for remembrance.
You must not use the Platform to submit, distribute or facilitate content or conduct involving:
unlawful material;
credible threats or incitement to violence;
harassment, intimidation or hate;
unlawful discriminatory content;
sexual or seriously inappropriate material incompatible with the service;
impersonation or fraud;
intentionally deceptive or materially misleading claims;
privacy or data-protection violations;
copyright or other intellectual-property infringement;
spam, unauthorised advertising or suspicious links;
malware or malicious code;
attempts to obtain unauthorised access;
interference with Platform security or operation.
Collective and Community Memorials remain remembrance-oriented features. They are not intended to function as a general-purpose political campaigning, petition or fundraising platform.
- Reporting and moderation
Where a Report Content control is available, you may use it to report a Memorial, Tribute or related content.
Please select the category that most accurately describes the concern and provide enough information to identify the material.
Submitting a report does not automatically remove content.
Authorised Comemoralis Staff may review reports and, where appropriate, hide a Tribute, restrict content or suspend a Memorial.
Suspension is distinct from permanent deletion.
Where the available workflow permits it, the Creator of a suspended Memorial may correct relevant issues and submit a restoration request.
Restoration requires review and is not automatic.
The reporting system does not constitute a general automated appeal, ownership-transfer or family-claim service.
Payment, Renewal or Reactivation does not override a moderation or Trust & Safety decision.
- Rights-holder, privacy and removal requests
For copyright, authority, family, content-removal or similar legal concerns, contact:
For personal-data and privacy matters, contact:
Please identify the relevant Memorial or content and explain the basis for your request.
We may request proportionate evidence of identity, authority, relationship or rights where reasonably necessary.
Requests are reviewed according to their circumstances and applicable law.
A family relationship or request does not automatically:
transfer administration of a Memorial;
replace an existing Creator;
establish copyright ownership;
require automatic removal of disputed material.
Nothing in these Terms limits obligations imposed by applicable law.
- Payments
When paid Creator Memorial services are available, the current Comemoralis model uses one-time payments rather than an automatically recurring subscription.
The Opening payment for a Creator-owned Memorial is US$17.99 and provides the first 12 calendar months of Administration & Preservation coverage from confirmed payment.
The payment period begins from confirmed payment rather than from a later publication date.
Renewal is US$12 for 24 calendar months.
Where Renewal occurs before existing coverage expires, the additional period is applied according to the applicable Billing lifecycle.
Renewal is manual.
Comemoralis does not automatically charge a recurring Renewal fee.
Platform-owned or Editorial Memorials are outside Creator Billing.
Where checkout is available, Paddle acts as Merchant of Record for the transaction.
Paddle handles payment processing and applicable checkout tax matters under its Buyer Terms and applicable policies.
Taxes or other mandatory charges may be calculated or presented by Paddle according to the purchaser's location and applicable law.
A checkout success page by itself does not establish payment entitlement if payment has not been confirmed through the applicable payment-processing workflow.
A pending, failed or otherwise unconfirmed payment does not activate paid coverage.
Confirmed payment does not automatically publish an incomplete Draft. Other publication requirements must still be satisfied.
- Refunds, withdrawal and payment adjustments
Purchases processed through Paddle are also subject to Paddle's applicable Buyer Terms and Refund Policy.
Consumers may have mandatory cancellation, withdrawal or refund rights under the law applicable to them.
In particular, consumers in the European Union or European Economic Area may in relevant circumstances have a 14-day statutory withdrawal right for distance contracts.
The application of that right, including any lawful exception or consequence of requesting that a digital service begin during the withdrawal period, depends on the applicable law, the nature of the transaction and the information and choices presented during checkout.
Nothing in these Terms is intended to waive or restrict a mandatory consumer right.
Where Paddle provides the applicable withdrawal or refund mechanism, requests may be submitted through Paddle's Buyer Support or Customer Portal.
For a service-related issue concerning Comemoralis, you may also contact:
Where a full refund reverses the payment that funded a Memorial's coverage, the corresponding entitlement may be adjusted.
Coverage created by another valid payment remains authoritative.
If an Opening payment is fully refunded and no other valid coverage exists, the Memorial may return to an unpaid state.
A refund does not itself require immediate deletion of Memorial content.
Refunding a Renewal or Reactivation payment may remove the coverage associated with that payment.
Partial refunds, tax adjustments, chargebacks or ambiguous payment adjustments may require manual operational review.
A payment adjustment does not itself trigger immediate Gallery purge or automatic permanent deletion of a Memorial.
- Administration & Preservation lifecycle
The current Creator Billing lifecycle is:
UNPAID → ACTIVE → RENEWAL_DUE → PRESERVATION → ACTIVE after confirmed Reactivation
RENEWAL_DUE begins 30 days before existing coverage ends while the Memorial's paid coverage remains active.
There is no separate automatic Grace state after expiry.
If valid paid coverage expires without Renewal, the Memorial enters Preservation Mode at expiry.
Preservation presentation
An otherwise available Memorial in Preservation Mode displays only a limited presentation, which may include:
Memorial title or name;
Primary Portrait or approved fallback;
a neutral Preservation notice;
permitted actions such as Reactivation.
Normal Life Story, narrative, descriptions, Gallery, Tributes and location sections are not shown while Preservation restrictions apply.
Private Memorials remain unlisted and retain their direct-link visibility characteristics.
Archived or Suspended Memorials do not become publicly available merely because they enter Preservation.
Restrictions during Preservation
Normal editing and content creation are restricted.
This includes, where applicable:
replacement of Primary media;
Gallery uploads;
new Tributes;
new Tribute media;
Creator replies or ordinary Tribute management.
Changing a Memorial from Public to Private and authorised deletion remain available where the applicable workflow permits them.
Changing a Private Memorial to Public requires Reactivation.
Trust & Safety remediation remains governed by the dedicated moderation workflow.
Retention and Gallery purge
Full retained Memorial content remains internally stored for 24 calendar months after entry into Preservation, subject to authorised deletion, lawful removal and other applicable legal requirements.
After that period, eligible Gallery photographs and videos may become eligible for permanent purge.
A Gallery purge requires the applicable lifecycle conditions to have been satisfied, including a successfully sent warning for the relevant Preservation cycle and at least 30 calendar days after that warning.
A late or uncertain warning cannot shorten this safety interval.
The Gallery purge does not automatically delete:
the Primary Portrait;
the Memorial record;
textual Memorial content;
Tributes and their media;
Final Resting Place information;
the Memorial URL;
relevant SEO information.
An underlying media file may also remain where another retained record still legitimately references that file.
Billing does not automatically hard-delete an entire Memorial.
These Preservation rules do not constitute a promise of eternal hosting or perpetual service availability.
Reactivation
Reactivation costs US$12 and creates a new 24-calendar-month coverage period beginning from confirmed Reactivation payment.
Comemoralis does not retroactively charge for time already spent in Preservation.
Retained content becomes available again subject to publication, visibility and moderation requirements.
Gallery media that has already been permanently purged cannot be restored through Reactivation.
Billing notices
The current lifecycle provides for up to three automated notices in an unpaid cycle:
a Renewal reminder approximately 30 days before expiry;
a Preservation notice when coverage expires;
a Gallery purge warning where the Gallery approaches the applicable purge threshold.
Operational delays may affect delivery.
Gallery purge nevertheless remains subject to the applicable successful-warning safety interval.
- Archive, deletion and ending use
Archiving a Memorial is distinct from permanently deleting it.
Archive is intended to be reversible where the applicable lifecycle and moderation state permits restoration.
Restoration preserves the identity of the Memorial and does not automatically alter its existing publication or visibility choices.
Public availability remains governed by publication status, visibility, Billing lifecycle and moderation.
Archive and restoration may be restricted while Preservation applies.
Authorised permanent deletion removes the Memorial and its ordinary dependent content subject to the retention, evidence, shared-content, storage and backup qualifications described below and in the Privacy Policy.
Comemoralis does not promise recovery of permanently deleted content.
Account deletion
Account deletion is designed to remove the account and ordinary account dependencies, including:
Creator-owned Memorials;
ordinary dependent Memorial content;
account-authored Tributes and dependent replies;
authentication identities;
active sessions;
account preferences and notifications.
Platform-owned or Editorial Memorials are not automatically deleted merely because the Staff account that administered them is removed.
Self-service deletion for a local-password account currently requires the account's password.
Google-only accounts do not currently have the same password-based self-service deletion workflow.
A Google-only user may nevertheless request erasure through:
Such sensitive requests may require proportionate identity verification.
Information that may remain
Limited financial, security or moderation evidence may remain where reasonably necessary for accounting, fraud prevention, disputes, legal obligations or the establishment, exercise or defence of legal claims.
A minimised operational deletion record may remain without preserving a recoverable user account.
Media still referenced by other legitimately retained content may remain.
Storage cleanup may occur separately from the primary database deletion process.
Backup copies may remain until they age out according to applicable infrastructure and recovery cycles.
Deletion is therefore not necessarily simultaneous across every technical storage layer.
Further information is provided in the Privacy Policy.
- Intellectual property
The Comemoralis software, name, branding, design elements and original Platform materials are protected by applicable intellectual-property rights.
Using Comemoralis does not grant you ownership of or an unrestricted licence to:
Comemoralis source code;
trademarks or branding;
proprietary Platform materials;
unrelated third-party material.
Rights in user-submitted content remain with the relevant lawful rights holders.
Attribution, source or rights metadata displayed with content does not itself prove ownership, establish permission or grant visitors a licence to reuse that content.
- Third-party services and infrastructure
Comemoralis uses third-party services to provide parts of the Platform.
These currently include, where applicable:
Laravel Cloud for application and database infrastructure;
Cloudflare R2-based object storage infrastructure for media storage;
Postmark for transactional email;
Google for optional authentication;
Paddle for purchases when paid checkout is available.
Each provider may have its own applicable terms, privacy policies and service conditions.
Their roles in relation to personal data are described further in the Privacy Policy.
Third-party websites or destinations accessed through external links or QR codes operate independently from Comemoralis.
Generating, publishing or displaying a QR code or external link does not mean that Comemoralis controls, guarantees or endorses the destination's content, security, accuracy or continued availability.
- Service availability
Comemoralis aims to provide a reliable remembrance service, but internet and cloud services cannot be guaranteed to operate without interruption.
Access may be affected by:
maintenance;
infrastructure failures;
security incidents;
provider outages;
necessary updates;
circumstances outside reasonable operational control.
Comemoralis does not make an absolute uptime guarantee or a promise of eternal service availability.
References to preservation describe the Platform's applicable product and retention model; they do not create an unlimited-duration hosting guarantee independent of these Terms, applicable law and the continued operation of the service.
User-submitted historical, biographical, genealogical, cemetery or other information is not necessarily independently verified by Comemoralis.
Reasonable changes to the service remain subject to applicable law and existing paid rights.
- Liability and mandatory rights
Nothing in these Terms excludes or limits liability, rights or remedies where doing so would be prohibited by applicable law.
In particular, nothing in these Terms is intended to exclude mandatory:
consumer protections;
data-protection rights;
liability that cannot legally be excluded or limited.
Comemoralis provides the technical environment through which Memorials, Tributes and related information may be created, stored, displayed and moderated.
Because much of this information is supplied by users, contributors or other sources, Comemoralis cannot independently guarantee the accuracy, completeness, authorship, legality or reliability of every contribution.
Comemoralis is not a substitute for official civil records, cemetery records, legal advice, medical or psychological care, emergency services or professional verification of genealogical or historical information.
Responsibility for any particular loss, dispute or legal issue is determined under the law applicable to the circumstances.
- Changes to these Terms
Comemoralis may update these Terms where reasonably necessary to reflect:
changes to the Platform;
new or changed functionality;
security requirements;
provider or infrastructure changes;
legal or regulatory requirements.
The current public version will display its latest update or effective date.
Where applicable law requires notice or renewed agreement for a material change, Comemoralis will take the measures required in those circumstances.
An update to these Terms does not retrospectively remove mandatory consumer rights or valid paid entitlements.
If the legal operation of Comemoralis is transferred in the future to a formally established Comemoralis Foundation or another entity, the Terms, Privacy Policy and relevant contractual arrangements will be reviewed and updated before that transition takes legal effect.
- Legal contact and current operator
Comemoralis is currently operated by Creative IT Media S.R.L.
Complete company and operator information is available on the Legal Information page.
Legal enquiries and content-related legal requests:
Privacy and data-protection enquiries:
Until a formally documented transition takes effect, Creative IT Media S.R.L. remains the legal operator responsible for providing the Comemoralis Platform under these Terms.
- Governing law and disputes
These Terms and the relationship between you and Creative IT Media S.R.L. in connection with the operation and use of Comemoralis are governed by Romanian law, subject to any mandatory rules that apply regardless of that choice.
If you use Comemoralis as a consumer, this choice of Romanian law does not deprive you of mandatory consumer protections that you are entitled to under the law of the country in which you habitually reside where those protections apply regardless of the chosen law.
Any dispute concerning Comemoralis may be brought before the courts that have jurisdiction under applicable law.
Nothing in these Terms requires a consumer to waive a right to bring proceedings before a court that applicable consumer law gives jurisdiction over the dispute.
Nothing in this section restricts your right to lodge a complaint with a competent consumer-protection, data-protection or other regulatory authority where such a right exists.
Where a purchase is made through Paddle, the payment transaction and Paddle's relationship with the purchaser are additionally governed by the applicable Paddle Buyer Terms, Refund Policy and mandatory consumer protections. Those payment terms do not remove the rights and obligations governing your use of Comemoralis under these Terms.
